2. Description of Service

ForensAI is a digital forensic analysis application that helps users analyze their own data exports from Google, Apple, Facebook, Instagram, Microsoft, Dropbox, Snapchat, TikTok & X to detect suspicious activity, account compromises, and security threats. The App operates entirely on your device and does not transmit your data to external servers.

Core Features:

• Analysis of data exports (Google Takeout, Apple Privacy Report, Facebook/Instagram exports, etc.)
• Detection of suspicious login patterns, unknown devices, geographic anomalies, and security events
• Risk scoring and assessment
• AI-powered summary generation
• PDF report generation (Pro feature)
• Local storage of files and analysis results

ForensAI does not provide legal, professional, or expert advice.

Results Are Not Legally Binding:

• Analysis results are for educational and informational purposes only
• Results are not certified or authenticated by forensic experts
• Results may not be admissible as evidence in legal proceedings
• Results should not be relied upon for legal, financial, or security decisions

Seek Professional Help When Needed:

• For legal matters: Consult with qualified attorneys and certified digital forensics experts
• For cybersecurity threats: Consult with certified information security professionals
• For account compromises: Contact platform support (Google, Apple, Facebook, etc.)

• Professional forensic services may be required for legal or serious security matters
• You are solely responsible for any decisions made based on ForensAI analysis

5. User Responsibilities

Data Ownership and Permissions:

You represent and warrant that:

• ✅ You own the data you analyze, OR
• ✅ You have explicit written permission from the data owner to analyze it
• ✅ You have legal right to access and analyze the data
• ✅ You will not use ForensAI to analyze data without proper authorization

Prohibited Uses:

You agree NOT to use ForensAI to:

• ❌ Access or analyze data you do not own or have permission to analyze
• ❌ Violate any laws, regulations, or third-party rights
• ❌ Infringe on privacy rights of others
• ❌ Perform unauthorized surveillance or monitoring
• ❌ Engage in stalking, harassment, or illegal activities
• ❌ Reverse engineer, decompile, or modify the App
• ❌ Distribute, resell, or commercialize the App
• ❌ Use the App for any illegal, fraudulent, or harmful purpose

Compliance with Laws:

You are solely responsible for ensuring your use of ForensAI complies with all applicable laws, including but not limited to:

• Data protection laws (GDPR, CCPA, etc.)
• Computer fraud and abuse laws
• Privacy and surveillance laws
• Laws governing digital evidence in your jurisdiction

6. Data Accuracy and Limitations

Results May Not Be Complete:

• ForensAI analyzes data based on patterns and heuristics
• False positives and false negatives may occur
• Analysis quality depends on:
  • Completeness of your data exports
  • Accuracy of data provided by platforms
  • Limitations of automated detection algorithms

No Warranties on Results:

We do not guarantee:

• Accuracy of analysis results
• Completeness of detected threats
• Absence of undetected security issues
• Suitability of results for any specific purpose

Your Interpretation:

• You are solely responsible for interpreting and acting on analysis results
• You acknowledge that results require human judgment and context
• You should seek professional review for serious matters

7. Pro Features and Payments

Free Tier:

ForensAI offers a free tier that includes:

• Basic scanning and analysis
• Risk scoring
• AI summary generation
• Limited findings display

Pro Tier:

ForensAI Pro is available as a one-time purchase ($179) and includes:

• Full access to all platforms
• Complete unredacted findings
• PDF report generation
• Unlimited scans

Payment Processing:

• iOS: Purchases processed through Apple's App Store (StoreKit)
• Android: Purchases processed through Google Play (Play Billing)
• We do not: Process payments directly, store payment information, or handle refunds
• Refunds: Handled by Apple or Google according to their policies

Purchase Terms:

• Pro purchase is a one-time fee, not a subscription
• Purchase grants lifetime access to Pro features on the device where purchased
• Purchase is non-transferable and tied to your Apple ID or Google Play account
• Refunds are subject to Apple's or Google's refund policies

Pro Feature Availability:

We reserve the right to:

• Modify Pro features
• Add or remove features
• Change Pro tier pricing (for new purchases only)

8. Intellectual Property

Our Rights:

ForensAI, including its:

• Software code
• User interface design
• Algorithms and detection rules
• Documentation
• Trademarks and logos
• Copyrighted content

...are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws.

Your Rights:

You retain ownership of:

• Data you upload
• Files you analyze
• Analysis results generated from your data
• PDF reports you create

License Grant:

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Use ForensAI on your personal devices
• Analyze your own data
• Generate reports for personal use

You may NOT:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Create derivative works based on the App
• Use our trademarks or branding without permission

9. Limitation of Liability

No Warranties:

FORENSAI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Accuracy or completeness of results
• Non-infringement
• Continuous or error-free operation

Limitation of Damages:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any direct, indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Losses arising from use or inability to use ForensAI
• Losses arising from analysis results or interpretations
• Losses arising from unauthorized access to your device or data
• Losses arising from decisions made based on ForensAI results

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.

Exceptions:

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. If you are located in such a jurisdiction, some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless ForensAI, its owners, employees, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any laws or third-party rights
• Your analysis of data you did not own or have permission to analyze
• Any decisions or actions taken based on ForensAI results

11. Privacy

Your use of ForensAI is also governed by our Privacy Policy, which explains how we handle information (or, in our case, how we don't collect information). Please review our Privacy Policy, which is incorporated into these Terms by reference.

Key Privacy Points:

• All processing happens on your device
• We do not collect, transmit, or store your data
• Optional geocoding services may send addresses/IPs to third parties (at your choice)

12. Third-Party Services

ForensAI may use or integrate with third-party services, including:

• OpenStreetMap Nominatim API: For address geocoding (optional)
• ipapi.co: For IP geolocation (optional)
• Apple App Store / Google Play: For app distribution and payments

These third-party services are governed by their own terms of service and privacy policies. We are not responsible for:

• The availability or accuracy of third-party services
• The privacy practices of third-party services
• Any issues arising from your use of third-party services

13. App Updates and Modifications

We Reserve the Right To:

• Update, modify, or discontinue the App at any time
• Add or remove features
• Change Pro features or pricing
• Release new versions requiring device updates

Updates:

• Updates may be delivered automatically through app stores
• Updates may modify these Terms (see "Changes to Terms" below)
• You may need to update your device's operating system to use new versions

Discontinuation:

• We reserve the right to discontinue the App or any features
• If we discontinue the App, you will retain access to locally stored data
• We are not obligated to provide ongoing support or updates

14. Termination

Your Right to Terminate:

You may stop using ForensAI at any time by:

• Uninstalling the App from your device
• Deleting all app data using "Clear App Data"

Our Right to Terminate:

We may suspend or terminate your access to ForensAI if:

• You violate these Terms
• You engage in illegal or harmful activities
• You infringe on intellectual property rights
• We are required to do so by law

Effect of Termination:

• Upon termination, your license to use ForensAI ends
• You may delete all app data
• Locally stored data remains on your device until you delete it
• Pro purchases are non-refundable (subject to app store policies)

15. Changes to Terms

We May Update These Terms:

• We reserve the right to modify these Terms at any time
• Material changes will be communicated by:
  • Updating the "Last Updated" date
  • Posting the updated Terms in the App Store listing
  • Including a notice in the App (for significant changes)

Your Continued Use:

• Your continued use of ForensAI after changes constitutes acceptance
• If you do not agree to changes, stop using the App
• Material changes may require you to re-acknowledge the Terms

16. Dispute Resolution

Governing Law:

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.

Informal Resolution:

Before filing a claim, you agree to:

• Contact us first to attempt informal resolution
• Provide a written description of the dispute
• Allow 30 days for us to respond

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ForensAI regarding your use of the App and supersede all prior agreements or communications.

19. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

20. Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign or transfer these Terms without restriction.
